ORDER

19.08.2026

02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.373 of 2026 pending on the file of learned S.D.J.M., Athagarh, arising out of Athagarh P.S. Case No.170 of 2026 for commission of offences punishable under Sections 126(2), 296, 115(2), 117(2), 351(3) and 3(5) of BNS, 2023.

3. On instruction, learned counsel for the State submits that apprehension of incarceration is misconceived, since the Petitioners are not accused of commission of any non-bailable offence.

4. In the light of such submission, the ABLAPL stands disposed of as not maintainable.

5. Liberty is granted to the Petitioners to renew their prayer, if they are accused of commission of any non bailable offence.
