ORDER

18.08.2026

02.

1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No. 890 of 2026 pending on the file of learned J.M.F.C. (Cog. Taking), Khordha, arising out of Jankia P.S. Case No.422 of 2026 for commission of offences punishable under Section 52(a)(i) of the Odisha Excise (Amendment) Act, 2016.

3. Learned counsel for the State on telephonic instruction which has been incorporated in a memo taken on record submits that the Petitioner has been wrongly cited as an accused in the FIR because of the confusion in the name inasmuch as the accused is one “Babindra” and the name of the Petitioner is “Rabindra”.

4. In view of the same, the ABLAPL is disposed of as not maintainable.

5. Liberty is granted to the Petitioner to renew his prayer if there is any threat perception.
