ORDER
18.08.2026
01.
1. Heard learned counsel for the Petitioners and learned counsel for the State.
2. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.258 of 2026 pending on the file of learned J.M.F.C., Khariar arising out of Khariar P.S. Case No.264 of 2026 for commission of offences punishable under Sections 109(1), 115(2), 117(2), 126(2), 303(2), 329(4), 351(2) and 3(5) of BNS, 2023.
3. It is submitted by the learned counsel that because of the counter FIR exaggerated allegations have been made more particularly relating to 109 of BNS and the injury suffered is simple in nature. Hence, the Petitioners may be protected by pre-arrest bail.
4. Learned counsel for the State opposes the prayer for pre-arrest bail referring to the antecedents of the Petitioners.
5. It is further submitted by the learned counsel for the Petitioners that the antecedents are year old and that ought not to weigh with this Court in considering the prayer of the Petitioners for pre- arrest bail.
6. Taking into account the nature of allegations and the punishment prescribed, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of nature of the injury.
If it comes to the fore that the injured has suffered any grievous injury, this order shall not be given effect to.
7. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.
8. Accordingly, the ABLAPL stands disposed of.
