ORDER

18.08.2026

03. 1. Since both the ABLAPLs relate to the same FIR, on the consent of the parties, they are taken up together for consideration and disposed of by this common order.

2. Heard learned counsel for the Petitioners and learned counsel for the State as well as the Informant.

3. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.812 of 2026 pending on the file of learned SDJM, Khordha arising out of Industrial Estate P.S. Case No.178 of 2026 for commission of offences punishable under Sections 85/115(2)/118(2)/109/3(5) of BNS, Act.

4. It is submitted by the learned counsel that the Petitioners in ABLAPL No.8816 of 2026 is the married sister-in-law of the victim and the Petitioner in ABLAPL No.7639 of 2026 is the nephew of the deceased.

5. It is submitted by the learned counsel for the Petitioners that being overcome with grief, the daughter of the deceased had filed the F.I.R wherein omnibus allegations have been made and in the meanwhile since the husband and the mother-in-law have been taken into custody, the Petitioners may be protected by pre-arrest bail.

6. Learned counsel for the State opposes such prayer.

7. It is submitted by the learned counsel for the Informant, Mr. Das Mohapatra, that on a bare perusal of the F.I.R, it is seen that the present Petitioners tried to portray the case as one of electric shock because of which the treatment was waylaid as such that the complicity cannot be undermined, and no leniency ought to be shown.

8. This Court perused the statement of the brother of the deceased and other materials on record.

9. On considering the same, taking into account the specific overt act having been attributed to mother-in-law and the husband, who are in custody and taking into account the tenor of the statement of the victim, which is stated by the brother of the deceased, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

10. It is further directed that Petitioners shall not in any way try to intimidate the Informant and her family.

11. It shall be open for the Informant/ prosecution to seek variance of this order in the event there is any threat perception.

12. It is further stated that the Petitioners shall cooperate with the ongoing investigation.

13. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
