ORDER
18.08.2026
01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case (R) No.1150 of 2026 pending on the file of learned J.M.F.C. (Rural), Cuttack arising out of Cuttack Sadar P.S. Case No.528 of for commission of offences punishable under Section 303(2) and 3(5) of The Bharatiya Nyaya Sanhita (BNS), 2023, Read with Section 51 of Odisha Minor Mineral Concession Rules, (OMMCR), 2016.
3. Learned counsel for the State opposes such prayer.
4. Taking into account the nature of allegations and punishment prescribed, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.
5. It is further stated that the Petitioner shall cooperate with the ongoing investigation.
6. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
