18.08.2026

01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.

2. Heard learned counsel for the Petitioner and learned counsel appearing for the Opp. Parties.

3. Petitioner has filed the present writ petition inter alia with the following prayer:- “It is, therefore, most respectfully prayed that your Lordship may graciously be pleased to admit this writ application and issue Rule NISI to the opp. party calling upon him to show cause as to why they shall not be directed to extend the benefit of pay protection in favour of the petitioner as has been given to the similarly situated persons and fix his pay accordingly and release the accrued arrear in favour of the petitioner within a stipulated period;

// 2 //

And on their failing to show cause or showing insufficient cause, the said Rule be made absolute; And pass such further order(s) as may be deemed fit and proper.

And for this act of kindness the petitioner shall, as in duty bound ever pray”.

4. However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a fresh representation before Opp. Party No.1 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three (3) weeks hence.

5. It is observed that if such representation is filed within the aforesaid time period, Opp. Party No.1 shall do well to take a lawful decision on the same within a period of three (3) months from the date of receipt of such representation. The order so passed by Opp. Party No.1 be communicated to the Petitioner.

6. Since it is contended that claim of the Petitioner is covered by an order passed by this Court on 05.10.2023 in W.P.(C) No.29644 of 2023 confirmed by the Apex Court in the meantime, relevancy and effect of the said order be taken into consideration while considering the Petitioner’s claim. Petitioner is directed to provide copy of this order along with order passed in W.P.(C) No.29644 of 2023 before Opposite Party No.1 for compliance.
