ORDER

Order No. 18.08.2026

(Through Hybrid Mode)

04.

1. This writ petition has been filed for quashing order dated 30.04.2026 passed by the M.I., Banarpal (Annexure-3) refusing to renew the license for PDS and directing the Petitioner to submit the EPOS device with accessories and electronic weighing scale to the M.I., Banarpal for taking further action.

2. Notice dated 29.06.2026 (Annexure-5) has also been challenged in this writ petition stating that this notice has been served on the Petitioner on 03.07.2026.

3. Order dated 01.07.2026 has been passed by the Collector, Angul in Misc. Appeal Case No. 01 of 2026 (Annexure-4) directing the Licensing Authority to issue a fresh order for withholding the allocation of quota, if felt necessary and further directing that proceedings for cancellation or otherwise should be completed within a period of sixty days from the new notice after giving an opportunity of hearing to the Petitioner and directing the Petitioner to comply with any such fresh order under Section 14 and to co-operate in the enquiry and posting the case to the next date.

4. It is stated by Mr. Amitabh Pradhan, learned Additional Standing Counsel that the appeal is pending for hearing before the Collector, Angul (in short “the Collector”).

5. From perusal of the order dated 01.07.2026 of the Collector, it is apparent that the impugned order dated

30.04.2026 is no longer in existence, as the Collector has directed for issuing fresh notice.

6. The grievance of the Petitioner regarding the fresh notice issued on 29.06.2026 is that although this notice has been served on 03.07.2026 and only three days time to file a reply, but the records were manipulated to indicate that the notice was issued on 29.06.2026, but could not be served on the Petitioner earlier as she refused to receive the notice.

7. As the appeal is pending before the Collector without going into the allegations in the writ petition, the writ petition is disposed of permitting the Petitioner to raise all her grievances and contentions before the Collector with a further direction to the Collector to dispose of the appeal in accordance with law after giving the Petitioner adequate opportunity of hearing.

8. It is also directed that, if any, application for interim relief is filed before the Collector, the same shall also be considered, in accordance with law.

9. Urgent certified copy of this order be granted on proper application.
