ORDER

01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.153 of 2026 pending on the file of learned J.M.F.C.(Cog-1), Puri arising out of Baliapanda P.S. Case No.35 of 2026 for commission of offences punishable under Section 109(1)/ 324(5)/ 308(4)/ 351(3)/ 111(2)(b)/ 111 (4)/ 61(2)(a)/ 49/ 3(5) BNS r/w section 3/4/6 of ES Act.
3. Learned counsel for the State opposes the prayer for pre-arrest bail.
4. Considering the nature of allegations and that the Petitioner has criminal antecedent, this Court is not inclined to entertain this application for pre-arrest bail. However, in the event the Petitioner surrenders before the learned Court in seisin in the aforesaid case and moves an application for his release on bail, the same shall be considered on its own merit.
Ground of parity, if so urged, relating to the release of the co-accused by this Court by order dated 23.07.2026 in ABLAPL No.7023 of 2026 as well as by order dated 27.07.2026 in BLAPL Nos.5055 of 2026, 5468 of 2026 and 6285 of 2026 shall be taken into account.
5. Accordingly, the ABLAPL stands disposed of.
