02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with C.T. Case No.363 of 2026 pending on the file of learned J.M.F.C., Kantamal, arising out of Manamunda P.S. Case No.243 of for commission of offences punishable under Section 85/296/115(2)/251(2) of BNS read with Section 4 of DP Act.
3. During the course of hearing, learned counsel for the State, on instruction, submits that in the meanwhile the Investigating Agency has resorted to the provisions contained in Section 35(3) of the BNSS.
4. In view of the same, since there is no perceptible threat of arrest, the ABLAPL stands disposed of.
