ORDER

18.08.2026

03. 1. Since both the ABLAPLs relate to the same FIR, on the consent of the parties, they are taken up together for consideration and disposed of by this common order.

2. Heard learned counsel for the Petitioners and learned counsel for the State as well as the Informant.

3. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.522 of 2026 pending on the file of learned J.M.F.C., Jaleswar arising out of Economic Offences P.S. Case No.30 of 2026 for commission of offences punishable under Sections 66- C and 66- D of the Information Technology (Amendment) Act 2008 read with Section 308, 318 (4), 319 (2) of Bharatiya Nyaya Sanhita (B.N.S.) 2023.

4. It is submitted by the learned counsel for the Petitioners that the husband of the Petitioner No.1 in ABLAPL No.8061 of 2026 (Jamini Kar) was one Prasanta Kar. Unfortunately he was terminally ill and succumbed to the disease. During his lifetime an amount of Rs.25,00,000/- was extended by the financial support of the company in which he was working and in this context he relies on Annexure-2 to ABLAPL No.9031 of 2026.

5. It is submitted that after passing away of the husband, there was concerted attempt to grab the amount by the in-laws and when she resisted, she and her brother were falsely implicated in the case at hand.

6. Learned counsel for the Informant on the other hand submits that this is a concocted story which is being put forth just to avail the order of pre-arrest bail. Hence, no credence be attached to the same.

7. Learned counsel for the State also opposes the same during the currency of investigation.

8. It is stated at the bar on instruction by the learned counsel for the Petitioner that in ABLAPL No.8061 of 2026, the balance in her three account is more than Rs.30,00,000/-. The accounts are under seizure. Such submission is not opposed by the learned counsel for the State.

9. Considering the rival submission, since the investigation in progress and the allegations is more or less based on documentary evidences, this

Court persuaded to hold that custodial interrogation of the Petitioners in ABLAPL No.8061 of 2026 is not warranted.

Hence, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner in ABLAPL No.9031 of 2026 and Petitioner Nos.2 to 4 in ABLAPL No.8061 of 2026 shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

10. So far as the Petitioner No.1 in ABLAPL No.8061 of 2026 (Jamini Kar) is concerned, taking into account the nature of allegations, it is directed that in the event of arrest of the Petitioner No.1 in ABLAPL No.8061 of 2026 (Jamini Kar)in connection with the aforesaid case, she shall be released on bail by the Arresting Officer on such terms and conditions deemed just and proper with further conditions that she will cooperate with the investigation.

11. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
