ORDER

18.08.2026

02.

1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with C.T. Case No.1082 of 2025 pending on the file of learned J.M.F.C., Basta, arising out of Singla P.S. Case No.276 of 2025 for commission of offences punishable under Sections 296/ 115(2)/ 109(1)/ 117(2)/ 351(2)/ 3(5) of BNS, 2023.

3. It is submitted by the learned counsel that exaggerated allegations have been made so far as the injury is concerned. Hence, the Petitioner may be protected by pre-arrest bail.

4. Learned counsel for the State opposes the prayer for pre-arrest bail referring to the statement of the complainant as well as the OPD prescription of Fakir Mohan Medical College & Hospital, Balasore.

5. On perusal of the medical documents, it is seen that the injured has suffered several injuries on the head.

6. Considering the seat of the injury and that the Petitioner has multiple antecedents, this Court is not inclined to entertain the application for pre-arrest bail. However, in the event the Petitioner surrenders before the learned Court in seisin in the aforesaid case and moves an application for his release on bail, the same shall be considered on its own merit.

7. The ABLAPL is accordingly disposed of.
