ORDER

18.08.2026

01.

1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.1457 of 2023 pending on the file of learned S.D.J.M., Angul arising out of Bantala P.S. Case No.391 of 2023 for commission of offences punishable under Sections 341, 323, 307, 379 and 34 of IPC.

3. This is the second journey of the Petitioner to this Court. Vide order dated 29.11.2023 in ABLAPL No.14007 of 2023 the Petitioner along with the co-accused were directed to be released on bail subject to “the injury sustained by the injured is found to be simple in nature”. Since the injury is grievous, the Petitioner has approached this Court.

4. It is submitted by the learned counsel that even if the entire allegations of prosecution are accepted at its face value, the role attributed to the petitioner does not in any way result in the injury which has been treated as grievous. Hence, the Petitioner may be protected by pre-arrest bail.

5. Learned counsel for the State opposes the prayer for pre-arrest bail referring to the materials on record.

6. Taking into account the rival submissions, this Court is not inclined to entertain the application for pre-arrest bail. However, it is directed that the Petitioner may surrender before the learned S.D.J.M., Angul in connection with the aforementioned case within one month from today.

In the event of his surrender and motion for bail, the same be considered by the learned S.D.J.M., Angul on merits, in the first hour of the day.

In the event of rejection of the prayer for bail by the learned S.D.J.M., Angul, the Petitioner is at liberty to move the higher forum for bail in the second hour on the same day.

7. On being so moved, the higher forum is requested to make an endeavor to dispose of the bail application of the Petitioner on the same day.

The case diary shall be made available to the concerned courts to facilitate disposal of the bail application of the Petitioner and learned S.D.J.M., Angul is called upon to transmit the case record to the higher forum in the second hour expeditiously in the event of rejection of the bail application by him.

8. Accordingly, the ABLAPL stands disposed of.

9. U.C.C. as per rules.
