ORDER
18.08.2026
01. 1. Heard learned counsel for the Petitioners and learned counsel for the State.
2. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.652 of 2024 pending on the file of learned S.D.J.M., Pallahara arising out of Pallahara P.S. Case No.370 of 2024 for commission of offences punishable under Sections 329(3), 115(2), 76, 351(2), 296 and 3(5) of BNS, 2023.
3. It is submitted by the learned counsel that during the course of investigation the Investigating Agency has taken recourse to the provisions contained in Section 35(3) of BNSS and while filing the charge sheet 76 of BNS has been added, since the same is non-bailable the Petitioner is apprehending that he may be remanded.
Learned counsel for the State submits that such apprehension is misconceived.
4. Learned counsel for the State opposes the prayer for pre-arrest bail.
5. Taking into account the nature of allegation and that during investigation the Petitioner’s custody is not sought for, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.
6. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.
7. Accordingly, the ABLAPL stands disposed of.
