04. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with Special G.R. Case No.49 of 2026 pending on the file of learned Special Judge under SC & ST Act, Deogarph, arising out of Barkote P.S. Case No.113 of 2026 for comission of offences punishable under Sections 115(2)/296/3(5)/351(3)/69/88 of BNS, 2023.
3. Learned counsel for the State, on instruction, submits that in the meanwhile the Investigating Agency has taken recourse to the provisions as contained in Section 35(3) of BNSS, 20232.
4. In view of the same, since there is no perceptible threat of arrest, the ABLAPL accordingly stands disposed of.
