ORDER
17.08.2026
02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.30 of 2025 pending on the file of learned NGN-cum-J.M.F.C., Odagaon, arising out of Sarankul P.S. Case No.13 of 2025 for commission of offences punishable under Section 103(1)/3(5) of BNS.
3. This is the second journey of the Petitioner to this Court.
4. It is submitted by the learned counsel for the Petitioner that in the meanwhile charge sheet has been filed and some of the co-accused have been released on bail. Hence, the Petitioner may be protected by pre-arrest bail, inter alia, on the ground of parity.
5. Learned counsel for the State opposes the prayer for pre-arrest bail.
6. It is trite that the ground of parity cannot be applied bereft of the factual matrix.
7. Considering the nature of allegation qua the Petitioner and on going through the 183 BNSS statement of the informant, sister of the deceased and the post-mortem report, this Court is not inclined to entertain the application for pre-arrest bail. However, in the event the Petitioner surrender before the learned Court in seisin in the aforesaid case and moves an application for their release on bail, the same shall be considered on its own merit.
Ground of parity, if so urged, shall be taken into account.
8. Accordingly, the ABLAPL stands disposed of.
