ORDER

17.08.2026

01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with Special Case No.229(B) of 2022 pending on the file of learned Sessions Judge, Balasore, arising out of Special Task Force P.S. Case No.18 of 2022, for commission of offences punishable under Sections 21(c) and 29 of NDPS Act, 1985.

3. It is submitted by the learned counsel that the Petitioner was before this Court in ABLAPL No.14427 of 2024, which was disposed of by order dated 18.12.2024 and by the said order liberty was granted to the Petitioner to seek bail taking into account the contraband to the tune of 1 Kg and 380 grams of brown sugar. This Court had also granted liberty to the Petitioner to rely upon the judgment of the Apex Court in the case of Tofan Singh V. The State of Tamil Nadu, reported in (2013) 16 SCC 31; and order dated 10.01.2022 in the matter of State by (NCB) Bengaluru Vs. Pallulabid Ahmad Arimuta and another (Special Leave to Appeal (Criminal) No.242 of 2022) keeping in view rigors of Section 37(1)(b)(ii) of NDPS Act.

4. It is further stated that because of overwhelming circumstances the Petitioner could not avail such order. Hence, this application.

5. Learned counsel for the State opposes the prayer for pre-arrest bail.

6. Considering the nature of allegations and in terms of the earlier order passed by this Court, this Court is not inclined to entertain the application for pre-arrest bail. However, in the event the Petitioner surrenders before the learned Court in seisin and moves an application for his release on bail, the same shall be considered on its own merit.

7. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
