ORDER

17.08.2026

07.

1. Heard learned counsel for the Parties.

2. This instant writ petition in the nature of the habeas corpus is at the behest of the father, seeking the production of a minor girl who has been kidnapped and kept in an unauthorised confinement.

3. Orders were passed from time to time to take all possible steps to rescue her from such captivity.

4. The learned Additional Standing Counsel submits that the girl has been rescued and produced before the CWC. Her statement was also recorded under Sections 180 and 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), wherein she disclosed various ill- treatment by her parents. Considering her statement, the CWC has kept her in a safe home. The girl is now in the custody of the CWC, and there is no justification in keeping the instant writ petition pending or directing the girl to remain physically present before this Court.

5. In view of the aforesaid facts, the writ petition is dismissed.
