ORDER
17.08.2026
01.
1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with C.T. Case No.688 of 2026 pending on the file of learned S.D.J.M., Balasore arising out of Balasore Town P.S. Case No.245 of 2026 for commission of offences punishable under Sections 189(2), 191(2), 191(3), 190, 115(2), 117(2), 109(1), 324(4), 221, 132, 296 and 351(2) of BNS.
3. It is submitted by the learned counsel that so far as the co-accused are concerned, they were released on pre-arrest bail vide order dated 20.07.2026 in ABLAPL No.7869 of 2026 and other connected matters.
4. The attention of this Court is drawn to the recitals of the said order that no materials could be placed regarding the injury suffered before the learned Trial Court, who has released some of the co- accused post arrest as well as before this Court while considering the earlier bail application of the co- accused persons referred to hereinabove.
5. In the light of the same, the learned counsel for the Petitioner submits that since the Petitioner is at all fours with the said accused persons, he may be protected by pre-arrest bail.
6. Learned counsel for the State opposes the prayer for pre-arrest bail.
7. Taking into account the nature of allegations and the release of the co-accused, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of the nature of the injury.
8. If it comes to the fore that the injured has suffered any grievous injury, this order shall not be given effect to.
9. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.
10. Accordingly, the ABLAPL stands disposed of.
