ORDER

17.08.2026

01.

1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with C.T. Case No.484 of 2026 pending on the file of learned J.M.F.C (V), Bhubaneswar, arising out of Bharatpur P.S. Case No.169 of 2026 for commission of offences punishable under Sections 296(b), 324(4), 76, 118(2) and 3(5) of BNS, 2023.

3. It is submitted by the learned counsel that during the course of investigation the Investigating Agency has taken recourse to the provisions contained in Section 35(3) of BNSS and charge sheet has been filed citing the Petitioner as not arrested.

4. It is stated that because the offences are triable by Court of Sessions, the Petitioner has reasonable apprehension of being remanded.

5. Learned counsel for the State opposes the prayer for pre-arrest bail.

6. Taking into account the nature of allegation and that during investigation the Petitioner’s custody is not sought for, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

7. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.

8. Accordingly, the ABLAPL stands disposed of.
