02. 1. Heard learned counsel for the Petitioners and learned counsel for the State.
2. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.401 of 2026 pending on the file of learned J.M.F.C. (R), Balasore, arising out of Rupsa P.S. Case No.68 of 2026 for commission of offences punishable under Sections 126(2)/118(1)/74/76/296/351(2)/303(2)/3(5) of BNS, 2023.
3. Perused the statement of the injured and considering the nature of allegations and the manner in which the assault has been taken place and the allegations relating to section 74 of BNS, this Court is not inclined to entertain this application of pre-arrest bail. However, it shall be open for the Petitioners to surrender and move for bail before the Court in seisin, which shall be considered on its own merit, without being prejudiced by the order passed by this Court.
4. The ABLAPL is accordingly disposed of.
