ORDER

13.08.2026

01.

1. The instant Public Interest Litigation is at the behest of the petitioner claiming himself as a social worker, raising concern over the rampant illegal encroachment by the squatters on the Government land, which impedes the width of the roads, the smooth commutation and market space of like nature.

2. It is further alleged that some of those encroachers are also indulged in illegal and immoral activities, yet the authorities are showing an apathetic attitude in not responding and/or taking appropriate steps in this regard.

3. Ms. Aishwarya Dash, learned Additional Standing Counsel (ASC) appearing for the State-opposite parties submits on instruction that after the complaint having been filed, steps were taken by the authorities and, in fact, notices were issued upon them. Subsequently, Form-‘Ka’ is also issued to those encroachers under the Odisha Prevention of Land Encroachment Act, 1972 and after taking all the stock of the matter, orders would be passed in terms of the provisions contained under the said Act.

4. In view of the fact that steps have already been taken for removal of the encroachers, we feel that the authorities should not show any leniency in this regard and must expedite the process as permitted under the said Act.

5. With these observations, the instant writ petition is disposed of.
