1. This CMP has been filed challenging the order dated 15.11.2016 passed by the learned Addl. Civil Judge (Senior
Division), Puri in C.S. No. 378 of 2004 (Annexure-1) allowing the petition filed by the plaintiff to cancel his earlier affidavit evidence and accept the later affidavit evidence and directing for expunging the affidavit evidence dated 05.08.2016 and examination in-chief dated 20.08.2016.
2. Pursuant to order dated 05.08.2026 a report dated 12.08.2026 has been received from the learned Additional Senior Civil Judge, Puri where it is stated that C.S. No.378 of 2004 has been disposed of on contest on 15.12.2022.
3. In view of the disposal of the Civil Suit, nothing remains to be decided in this CMP, which is accordingly dismissed.
4. Interim order passed earlier stands vacated. Misc. Case No.1871 of 2016 stands disposed of.
