ORDER

13.08.2026

01.

1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with C.T. Case No.732 of 2026 pending in the Court of learned J.M.F.C. (CITY), Balasore, arising out of Balasodre Sadar P.S. Case No.386 of 2026 for commission of offence punishable under Sections 125(a)/125(b)/281 of BNS, 2023.

4. It is submitted that notwithstanding the unfortunate passing away of the injured, there has been no change of sections in the FIR.

5. The alleged offences, as borne out from the FIR, are bailable in nature.

6. Accordingly, the ABLAPL is held to be not maintainable and the same is disposed of as such giving liberty to the Petitioner to renew his prayer, if

he is accused of commission of any non-bailable offense.
