ORDER
05. 07.08.2026
1. This matter is taken up through hybrid mode.
2. This CONTC has been filed alleging non-compliance of order dated 30.01.2025 passed by this Court in W.P.(C) No. 991 of 2025.
3. A compliance affidavit (at Flag ‘B’) has been filed by the Special Land Acquisition Officer, Lower Indra Irrigation Project, Khariar, District-Nuapada stating that the amount re-determined under Section 28-A of the Land Acquisition Act, 1894 (for brevity ‘the Act’) has already been sanctioned by the Administrative Department. However, in spite of repeated notices, the decree holders are not turning up to receive the amount by submitting relevant documents for verification. The Special Land Acquisition Officer is ready to disburse the decretal puspa dues in terms of the order passed in W.P.(C) No. 991 of 2025 if the decree holders cooperate.
4. Mr. Bijaya Kumar Behera, learned counsel for the Petitioner submits that the land losers shall appear on 24th August, 2026 before the Special Land Acquisition and RR Officer, Lower Indra Irrigation Project, Khariar in the District of Nuapada with relevant documents to receive the compensation.
5. In the event, the Petitioner along with other land losers appear before the Special Land Acquisition and RR Officer, Lower Indra Irrigation Project, Khariar on 24th August, 2026, the amount so sanctioned in their favour shall be released forthwith with proper acknowledgement on proper verification of the documents and their identification.
6. In view of the compliance affidavit filed, the contempt proceeding is dropped and the CONTC is disposed of accordingly.
