ORDER
07.08.2026
01.
1. This is an application under Article 227 of the Constitution of India seeking a direction upon the learned Senior Civil Judge, Talcher to dispose of C.S. No.127 of 2023. The said suit is filed by the petitioner for declaration of their share in respect of a joint property and the separation thereof.
2. It appears that an application under Order 18, Rule 1 of the Code of Civil Procedure, 1908 was filed for an order upon by the defendant Nos.1 to 5 to lead the evidence first. The said application was disposed of on 17.02.2026. Even thereafter two dates were fixed but the adjournment was sought by the opposite parties and the fact remains that the witness action has not commenced. Since the suit is otherwise ready for final disposal, this Court requests the learned Senior Civil Judge, Talcher to make an endeavour to dispose of the suit pending before it, as expeditiously as possible, preferably within a period of eight months from the date of communication of this order.
3. With the aforesaid observation, the instant application stands disposed of.
