1. This CMP has been filed challenging the order dated 04.07.2016 passed by the learned Civil Judge (Junior Division), Balangir in Title Suit No. 68 of 1986 (Annexure-3), rejecting the application filed by the plaintiff to recall P.W.4 for his further examination.
2. While issuing notice on 06.09.2016, this Court had stayed operation of the order dated 04.07.2016 passed by the learned Civil Judge (Junior Division), Balangir in Title Suit No. 68 of 1986.
3. Memo has been filed by Mr. Anupam Dash, learned counsel for the Petitioner stating that in view of the subsequent development, the matter has become infructuous, for which it may be disposed of. The said memo is taken on record.
4. Considering the said memo filed, no useful purpose will be served by keeping the CMP pending, which is accordingly dismissed.
5. The interim order stands vacated. Misc. Case No. 1213 of 2016 stands disposed of.
6. Urgent certified copy of this order be granted on proper application.
