1. This CMP has been filed challenging the order dated 03.12.2016 passed by the learned Civil Judge (Senior Division), Talcher in Civil Suit No. 264 of 2009, rejecting the application filed under Order 1 Rule 10(2) of the CPC.
2. While issuing notice on 21.12.2016, this Court had stayed operation of the order dated 03.12.2016 passed by the learned Civil Judge (Junior Division), Balangir in Civil Suit No. 264 of 2009.
3. Ms. L. Pradhan, learned counsel for the Petitioner submits that the matter has been rendered infructuous as in the meanwhile the suit has been disposed of.
4. Considering the said submission, no useful purpose will be served by keeping the CMP pending, which is accordingly dismissed.
5. The interim order passed earlier stands vacated. Misc. Case No. 1967 of 2016 and I.A. No. 152 of 2022 stand disposed of.
6. Urgent certified copy of this order be granted on proper application.
