1. This CMP has been filed challenging the orders dated 06.08.2015 and 08.10.2015 passed by the learned District Judge, Puri in R.F.A. No. 130 of 2014, allowing the application filed by the Opposite Party (Respondent) under Order 1, Rule 10 of the CPC.
2. While issuing notice on 19.11.2015, further proceedings in RFA No.130 of 2014 had been stayed by this Court.
3. On 22.07.2026, report had been called for from the learned District Judge, regarding status of R.F.A. No. 130 of 2014.
4. Report dated 28.07.2026 has been received from the learned 2nd Additional District Judge, Puri, where it is stated that R.F.A. No.130 of 2014 has been dismissed for default of the appellant on 22.04.2025 and has been consigned to the District Court Record Room on 20.06.2025.
5. As R.F.A. has been dismissed for default, no useful purpose would be served by keeping this CMP pending, which is accordingly dismissed.
6. Interim order stands vacated and Misc. Case No.1565 of 2015 stands disposed of.
