05. (Through Hybrid Mode)
1. This CMP has been filed challenging the common order dated 11.04.2016 passed by the learned Civil Judge (Junior Division), Bhadrak in Civil Suit No.46 of 2000-I, rejecting the petitions dated 10.02.2016 and 05.04.2016 filed by the plaintiffs under Order 6 Rule 17 of the CPC for amendment of the plaint.
2. While issuing notice on 15.07.2016, this Court has stayed further proceeding in Civil Suit No.46 of 2000-I, pending before the learned Civil Judge (Junior Division), Bhadrak.
3. Registry has pointed out that notice has been served on Opposite Parties No.1 to 13 and neither A.D. nor unserved notice is back from Opposite Parties No.14 and 15.
4. On 28.07.2026 none had appeared for the parties but for the interest of justice the matter was directed to be listed today.
5. None appears for the Petitioner when the matter was called today in the first hour.
6. The matter is passed over as learned counsel for the Petitioner had appeared in another case which had been listed today. LATER
7. None appears for the Petitioner when the matter is called.
8. Hence, the CMP is dismissed for non-prosecution.
9. Interim order passed earlier stands vacated. Pending interim application stands disposed of.
10. This order be communicated to the learned trial Court by the Registry.
