ORDER

30.07.2026 (Hybrid Mode)

01.

1. The petitioner before this Court has stated to be a resident of village Kuruan in the district of Bargarh. By filing the writ petition he challenges the notice annexed to the writ application dated 18.12.2025 issued by the Tahasildar, Bargarh. Perusal of the said notice indicates that the petitioner has occupied a land granted under the ‘Basundhara Yojana’ for constructing/having dwelling house in the village, instead he is cultivating the said land and has been directed to vacate within seven days.

2. The representation made at Annexure-2 is in ‘English’. The petitioner has signed the application in ‘Odia’. Though it is mentioned in the application that the petitioner has been explained the contents of the application in ‘Odia’ after he has been explained and has understood, but the application has been made for settlement of land under the Odisha Prevention of Land Encroachment (OPLE) Act, 1972 read with the Rules, 1985; whereas the notice to the petitioner is not to cultivate the land allotted under the ‘Basundhara Yojana’, which is a Government Scheme of allotment of land for dwelling houses to citizens.

3. At this stage, learned counsel for the petitioner seeks leave of the Court to withdraw the application to move the authority for redressal of his grievances.

4. The learned AGA in response submits that if the petitioner moves the authority for redressal of any of his grievances, the same shall be dealt with in accordance with law.

5. The writ petition is disposed of.

The petitioner shall find his remedy if available under law.
