1. This CMP has been filed challenging the order dated 05.09.2014 passed by the learned Civil Judge (Junior Division), Aska in C.S. No. 7 of 2012, rejecting the application filed by the defendant for return of the plaint.
2. While issuing notice on 12.09.2014, this Court had stayed further proceeding in civil suit.
3. On 22.07.2026, the matter had been adjourned on prayer made on behalf of Ms. Deepali Mohapatra, learned counsel for the Petitioner and had been adjourned to today and directing steps for substitution of Petitioner No.1 may be taken in the meanwhile.
4. Today when the matter is taken up, a memo is filed by Ms. Deepali Mohapatra, learned counsel for the Petitioner stating that the Civil Suit No. 07 of 2012 out of which the CMP arises has been disposed of on 25.11.2024. The said memo is taken on record.
5. In view of the disposal of the civil suit, nothing remains to be decided in the CMP, which is accordingly dismissed.
6. Interim order passed earlier stands vacated and pending interim applications stand disposed of.
7. Urgent certified copy of this order be granted on proper application.
