1. This CMP has been filed challenging the order dated 23.02.2016 passed by the learned Civil Judge (Senior Division), 1st Court, Cuttack in CMA No. 75 of 2013 refusing to recall compromise order dated 11.05.2012 and decree dated 19.05.2012 drawn up in C.S. No. 969 of 2010.
2. On 23.07.2026, Ms. P. Sarangi, learned counsel had appeared on behalf of the Opposite Parties. No counsel appeared on behalf of the Petitioner therefore in the interest of justice the matter was adjourned to today.
3. Today, when the matter is called, none appears on behalf of the Petitioner or the Opposite Parties.
4. No interim order has been passed in this case.
5. As more than ten years have elapsed since the impugned order was passed and no counsel appears on behalf of the parties, it can safely be presumed that due to passage of time, this CMP has become infructuous.
6. No useful purpose will therefore be served by keeping the CMP pending, which is accordingly dismissed.
