ORDER

Order No.

05. 28.07.2026

(Through hybrid Mode)

1. This CMP has been filed challenging the order dated 27.04.2016 passed by the learned Civil Judge (Senior Division), Baripada in Civil Suit No. 165 of 2005 (Annexure- 5).

2. While issuing notice on 04.07.2016, this Court had stayed further proceeding in C.S. No. 165 of 2005.

3. None appears for the Opposite Parties when the matter is taken up.

4. Mr. A. Dash, learned counsel for the Petitioners submits that in the meanwhile the suit has been disposed of, for which the CMP has become infructuous. To that effect, he files a memo stating that the Petitioners do not want to pursue the matter any further and hence the present CMP may be permitted to be withdrawn. The said memo is taken on record.

5. In view of the submission and the memo, the CMP is dismissed as infructuous.

6. Interim applications stand disposed of.
