ORDER
Order No. 27.07.2026
01.
1. This matter is taken up through hybrid mode.
2. Grievance of the Petitioner, in this writ petition, is with regard to inaction of the Debts Recovery Tribunal, Odisha, Kataka in pronouncing judgment in S.A. No.39 of 2024 filed under Section 17 (1) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act).
3. Mr. Dash, learned counsel for the Petitioner drawing attention of this Court to order dated 7th January, 2026 passed in S.A. No.39 of 2024 submits that the hearing was concluded on the said date and the matter was posted to 4th February, 2026 for pronouncement of judgment in S.A. Since then, the matter is being adjourned to different dates but the judgment in S.A. No.39 of 2024 has not yet been pronounced. Thus, finding no other alternative, the Petitioner has approached this Court by filing the present writ petition.
4. Taking note of the grievance of the Petitioner and on perusal of the record, this Court disposes of the writ petition with an observation that the Petitioner, if so advised, may bring the provision under Section 17(5) of the SARFAESI Act, 2002 to the notice of the Debts Recovery Tribunal, Odisha, Kataka and shall make a request for pronouncement of the judgment. It is expected that the judgment in S.A. No.39 of 2024 is pronounced at an early date by the Debts Recovery Tribunal, Odisha, Kataka to avoid any further complicacy.
