3. It is submitted by Mr. Rout, learned counsel for the Petitioner that SA No.181 of 2025 under Section 17 (1) of the Securitization and Reconstruction Financial Assets and Enforcement Security Digitally Signed Signed by: SASHIKANT PARIDA Reason: Authentication Location: OHC Date: 28-Jul-2026 14:54:03 Signature Not Verified

Interest Act, 2002 (for brevity the ‘SARFAESI Act’) was filed in the month of October, 2025. Mandate of Section 17 (5) of the SARFAESI Act, requires the Debts Recovery Tribunal, Odisha, Kataka to dispose of the application as expeditiously as possible, preferably within a period of four months as the outer limit. Till date, no endeavour has been made by the Debts Recovery Tribunal for early disposal of the said application. Being aggrieved by the inaction of the Debts Recovery Tribunal, this writ petition has been filed.

4. Mr. Pattnayak, learned Senior Panel Counsel for Union of India submits that in view of Section 17 (6) of the SARFAESI Act, the Petitioner should have approached the Debts Recovery Appellate Tribunal for redressal of his grievances, if the application filed under Section 17 (1) of the SARFAESI Act is not disposed of within the stipulated period as prescribed under Section 17 (5) of the SARFAESI Act.

5. In view of the above, this Court is not inclined to entertain the writ petition. Accordingly, the writ petition is disposed of with an observation that the Petitioner, if so advised, may work out its remedy in accordance with law.
