1. The CMP has been filed to set aside the order dated 20.11.2015 passed by the learned Civil Judge (Senior Division), Berhampur, Ganjam in Civil Suit No. 230 of 2006 (Annexure-5) rejecting the application filed by the Petitioners who were Defendants No.5, 6 and 9, for amendment of the written statement.
2. Mr. M.K. Rajguru, learned counsel appearing on behalf of the sole Opposite Party-Plaintiff files the photostat copy of the judgment dated 06.01.2025 passed by the learned 1st Additional Senior Civil Judge, Berhampur in C.S. No. 230 of 2006 (E Court No. 1511/2014) which indicates that the suit has puspa been dismissed on contest. The said memo and copies of the judgment and decree are taken on record.
3. In view of the above developments, nothing remains to be decided in the CMP, which is accordingly dismissed.
4. Urgent certified copy of the order be granted on proper application.
