04. (Through hybrid Mode)
1. This CMP has been filed challenging the order dated 24.02.2016 passed by the learned Civil Judge (Senior Division), Baripada in C.S. No. 371/2011 allowing the application filed under Order 1 Rule 10 of the CPC by the plaintiff who is the Opposite Party No.1 in the CMP.
2. None appears for the Opposite Party No.1 when the matter is called.
3. Notice had been issued in the CMP on 28.09.2016 but no interim order has been passed staying the further proceeding in the suit.

4. Hence, it can safely be presumed that since more than 10 years have elapsed since the impugned order was passed, the suit must have been disposed of in the meanwhile.
5. The CMP is dismissed. However, liberty is granted to the Petitioner for revival of the CMP within a period of four weeks, in case, cause of action still survives.
6. Urgent certified copy of the order be granted on proper application.
