ORDER

Order No. 23.07.2026

(Through Hybrid Mode)

06.

1. This CMP has been filed challenging the order dated 28.09.2015 passed by the learned Civil Judge (Junior Division), Kendrapara in C.S. No. 111 of 2008 rejecting the application of the Petitioner for substitution of deceased – defendant no.1 and the condonation of delay as because the said application had not been accompanied by a petition to set aside the abatement of the suit.

2. Mr. J.R. Kar, learned counsel for the Petitioners submits that in the meanwhile the suit has been disposed of. Hence the CMP has become infructuous.

3. In view of this submission, nothing remains to be decided in the CMP, which is dismissed.

4. Urgent certified copy of this order be granted on proper application.
