04. (Through hybrid Mode)
1. The CMP has been filed by the Petitioners who are Defendant Nos. 1 and 2 in Civil Suit No. 176 of 2011 challenging the order dated 21.11.2013 allowing the application of the plaintiff to implead one Laxmipriya Pothal as a defendant in the suit and order dated 18.04.2016 filed under Section 114 read with Order 1 Rule 10 (2) of CPC to strike out the name of Laxmipriya Pothal from the cause title of the suit.
2. Notice had been issued on 07.02.2017 by this Court but no interim order had been passed. In the meanwhile, more puspa than nine years have elapsed.
3. None appears for the Petitioners or the Opposite Parties when the matter is called.
4. Hence, it is presumed that Civil Suit No. 176 of 2011 has been disposed of by the leaned Civil Judge (Senior Division), Jagatsinghpur in the meanwhile.
5. The CMP is therefore dismissed.
6. Urgent certified copy of the order be granted on proper application.
