ORDER
23.07.2026
03. (Through Hybrid Mode)
1. This application has been filed challenging the order dated 17.11.2015 passed by the Learned Civil Judge (Sr. Division), Sundargarh in L.A. Reference Case No. 333 and 334 of 2013 rejecting the petition filed under Section 10 of the CPC for staying of further proceeding till disposal of RSA No. 407 of 2012 pending before the High Court of Orissa.
2. This case had been filed on 08.12.2015 and thereafter has been listed once on 24.12.2015 when a coordinate Bench of this Court directed to list the matter before the assigned Bench after the ensuing Winter Holidays. More than ten and half years have elapsed in the meanwhile and the matter is listed today.
3. In the absence of any interim order passed by this Court, it can safely be presumed that the Suit must have been disposed of in the meanwhile.
4. Hence, the CMP is dismissed.
5. However, liberty is granted to the Petitioner to file an application for revival of this application / recall of this order within a period of four weeks, in case any cause of action still survives.
