1. This CMP has been filed by the plaintiff challenging the order dated 02.04.2016 passed by the learned Senior Civil Judge, Bhubaneswar in I.A. No. 824 of 2013 and I.A. No. 1 of 2016 arising out of C.S. No. 1695 of 2013, allowing the application filed under Order 39 Rule 7 of the CPC and Order 26 Rule 9, by the defendant.
2. Ms. S. Das, learned counsel appearing on behalf of Mr. A. Behera, learned counsel for the Petitioner submits that this CMP has been rendered infructuous as in the meanwhile Civil Suit No.
1695 of 2013 has been dismissed vide judgment dated 23.09.2019 and decree dated 17.10.2019.
3. In view of this submission, the CMP is dismissed. All pending Misc. Cases stand disposed of.
4. Urgent certified copy of this order be granted on proper application.
