1. This CMP has been filed challenging the order dated 19.03.2014 passed by the learned District Judge, Balasore in RFA No. 25/2006-104/2004-I allowing the application under Order 26 Rule 9 of the CPC.
2. Mr. G.R. Sahoo, learned counsel appearing on behalf of Mr. M.R. Baug, learned counsel for the Petitioner submits that the CMP has been rendered infructuous.
3. Considering the said submission, the CMP is dismissed. Misc. Case No. 310 of 2014 stands disposed of.
4. Interim orders passed earlier are vacated.
