ORDER

17.07.2026

This complaint alleges non-compliance of the order dated 22.08.2025 entered in complainant’s WP(C) No.22986 of 2025.

At the stage of admission, learned AGA Ms. Pattanayak has produced the subject order. In the last paragraph, the Sub-Collector, Angul, who happens to be the contemnor herein has stated as under: “In the above context, a meeting was re-convened by the Sub- Collector, Angul on dtd. 09.4.2026 and in the said meeting it was decided that both truck owners' associations will jointly sit together and arrive at an amicable settlement for the loading and transportation of ash from Nalco with maintaining peace and discipline. If required, the work will be carried out under the supervision of Nalco authorities and the Nalco Police Station officials, ensuring the maintenance of law and order. The copy of the said proceeding is annexed as "ANNEXURE-D".”

Learned counsel appearing for the complainant vehemently argues that there is no due compliance and therefore, the proceedings should be kept on and that the contemnors be tried. We do not agree with this, inasmuch as, the Contempt Court cannot undertake a critical examination of the compliance.

In the above circumstances, the proceedings are dropped with liberty to the complainant to agitate the leftover grievances elsewhere in accordance with law and in that connection all contentions are kept open.

Web copy of this order to be acted upon by all concerned.
