ORDER

17.07.2026

01.

1. This writ petition, filed as a social action litigation, has the following script of prayer:

“It is therefore, prayed that this Hon’ble Court may graciously be pleased to admit this PIL Writ petition, issue Rule NISI by calling upon the Opposite Parties to show cause, as to why the environment of the Pubusahi village shall not be protected by way of stopping of the discharge of sewage/toilet water by constructing a proper concrete drainage with cover slab in order to stop the environmental pollution from Hanuman Mandir to Shani Mandir in the village of Pubusahi under Khordha Gram Panchayat in the district of Khordha.

And further be pleased to issue a Writ of Mandamus, by directing the Opposite Parties more particularly the opposite party No.2 to 4 for immediate execution of the work order proposal under Annexure-3 for the interest of justice.

And may further be pleased to issue any other Writ(s) or pass any other order(s) as this Hon’ble Court may deem fit and proper; And for this act of kindness the petitioner shall as in duty bound ever pray.”

2. Learned Additional Government Advocate (AGA) Mr. Debashis Tripathy present at the time of preliminary hearing submits that the office of the Advocate General has received a letter i.e. Letter No.2410 dated 17th July, 2026, which addresses the grievance raised and ventilated in the petition and, therefore, in terms of that, petition be disposed of.

3. Having heard learned counsel for the parties and having perused the papers, we broadly agree with the submission of learned AGA, whose version is founded on the subject Letter dated 17th July, 2026 mentioned above. The said letter has the following script:- “Letter No-2410 Date:- 17.07.2026

To,

The Advocate General, Odisha, Cuttack.

Sub: Factual appraisal in W.P.(C) No.18176 of 2026 (Satya Narayan Dash –Vs- State of Odisha & Others).

Sir,

In inviting reference to the subject cited above, I am to submit that the grievance relating to construction of a drain at Pubusahi under Khordha Gram Panchayat was enquired into by the Junior Engineer and Assistant Executive Engineer, Khordha Block. Based on the enquiry an amount of Rs.4.00 lakh has been sanctioned under BGBO scheme for financial year 2025-26 for construction of the drain and the detailed estimate has already been prepared.

Since a dispute arose regarding the land alignment, the Tahasildar, Khordha was requested to undertake demarcation of the land so that the exact boundary and alignment of the proposed drain could be finalized before commencement of the work. As discussed with the Tahasildar, Khordha, the demarcation of the said land is proposed to be taken up on 24.07.2026 (Friday). On receipt of the demarcation report, the work will be taken up for execution as per the approved estimate.

This information is submitted for favour of kind information and appraisal before the Hon’ble High Court.

Yours faithfully,

Block Development Officer

Khordha”

4. Learned AGA on being confronted with the letter in question submits that now the State having already sanctioned finance of a fund of Rs.4 lakh for doing the work in question, if a reasonable period is prescribed by the Court, the same would be accordingly accomplished.

5. In our considered view, a period of two months would be sufficient for accomplishing the task in question in terms of the said letter.

6. In the above circumstances and with the above observation, the instant writ petition is disposed of.
