ORDER
15.07.2026
01.
1. The instant writ petition, in the nature of Public Interest Litigation (PIL), is filed by the petitioners assailing the Environmental Clearance dated 30th April, 2025 issued by the Ministry of Environment, Forest and Climate Change, Government of India, with a further prayer for exclusion of the irrigated agricultural lands of Cluster 2 (Hansamura Katapali) from the project area and relocate the proposed expansion project to a suitable alternative site in strict compliance with the terms of reference and standard conditions.
2. It appears that the petitioners have raised the grievance in relation to the Environmental Clearance certificate granted by the Ministry of Environment. Since the petitioners have expressly and especially challenged the action of the Government in relation to the discharge of their solemn duty under the aegis of the provision of law, we feel that the PIL is not an appropriate remedy in this regard. We, therefore, direct the office to register the instant PIL as a regular writ petition and assign appropriate number in this regard.
3. Let the matter be listed before the appropriate Bench having a determination to take up such issue.
