ORDER

13.07.2026 This Intra Court Appeal filed by the State and its officials seeks to call in question a learned Single Judge’s order dated 16.01.2024, whereby Respondent-employee’s W.P.(C) No.42585 of 2023 having been favoured, the following relief has been accorded to him: “7. In view of the above settled position of law, nothing remains to be reconsidered by this Court. Accordingly the opposite parties are directed to extend all such benefits in favour of the petitioner in terms of the directions given by the Courts as mentioned above, as expeditiously as possible, preferably within a period of three months from the date of communication of the certified copy of the order.

8. With the above observation/direction, the writ petition stands disposed of.”

2. The Appeal having been filed after brooking a delay of 375 days, an application in I.A. No.653 of 2025 supported by affidavit has been filed seeking condonation thereof.

3. Learned AGA-Mr. Behura appearing for the Appellants fervently submits that the subject matter of this Appeal is covered by the decision of a Coordinate Bench of this Court in W.A. No.17 of 2023 between State of Odisha v. Krushna Chandra Mallick, heard & decided vide order dated 15.07.2025. He has also offered some explanation in the application, which is more or less plausible.

4. Learned counsel appearing for the Respondents very fairly submits that delay may be condoned and Appeal be disposed off, in terms of Krushna Chandra Mallick supra. We agree. In the above circumstances, this Appeal is disposed off, in terms of the decision in Krushna Chandra Mallick supra. The Appellants are directed to implement the impugned order within an outer limit of eight weeks, failing which it shall invite contempt action.

Web copy of this order to be acted upon by all concerned.
