ORDER

13.07.2026

The petition prayer reads as under:

“It is, therefore, prayed that this Hon'ble Court may graciously be pleased to admit this writ application, issue Rule NISI in the nature of a writ of mandamus/certiorari, directing the learned Debts Recovery Tribunal, Cuttack to dispose of S.A. No. 09 of 2025 within a stipulated time period.

And further be pleased to pass any other order/orders, direction/directions, writ/writs as deemed fit and proper;”

2. Learned counsel appearing for the Petitioner submits that right to speedy justice being one of the facets of Article 21 of the Constitution of India in the light of catena of decisions of the Apex Court, the DRT is not justified in keeping S.A. No.09 of 2025 pending indefinitely. We agree.

3. Notice to other side is dispensed with, since it will have full opportunity before the DRT when the said SA is taken up for consideration and further the prayer of the Petitioner is very innocuous.

In the above circumstances, Petition is disposed off requesting the DRT, Cuttack to hear and disposed off S.A. No.09. of 2025 within an outer limit of three (3) months, all contentions having been kept open.

Registry to send a copy of this order to the other side by speed post immediately.
