ORDER

Order No.

01. 10.07.2026

(Through hybrid Mode)

1. This CRLMP has been filed with the prayer to direct the Opp. Party No.4 to register FIR on the basis of the written information submitted by the Petitioner under Annexure-1 which is dated 03.04.2026.

2. Mr. R.R. Das, learned counsel for the Petitioner submits that the land of the Petitioner was demarcated on 07.11.2025 by the Tahasildar, pursuant to order dated 25.09.2025 passed in WPC No. 27614 of 2025, in presence of boundary tenants. On 23.03.2026, while the Petitioner was raising boundary construction over her land by engaging labourers, the accused persons abused the workers in filthy language and threatened them with dire consequences and obstructed the construction work. So the petitioner submitted a written complaint on 25.03.2026 before the IIC, Nandankanan Police Station. Even though the complaint disclosed commission of cognizable offences, the IIC, Nandankanan Police Station did not register any case for which written representation was submitted to the DCP, Bhubaneswar by speed post on 03.04.2026. Even though more than three months have elapsed in the meanwhile neither any case has been registered nor any inquiry conducted, for which the CRLMP was filed.

3. After hearing learned counsel for the Petitioner, in view of the nature of allegations, and the decision of the Supreme Court in the case of Sudhir Bhaskarrao Tambe v. Hemant Yashwant Dhage (2016)6 SCC 277 , the CRLMP is disposed of granting liberty to the Petitioner to avail the alternative remedy which is available to her for redressal of her grievance.

4. Urgent certified copy of this order be granted as per rules.
