ORDER

Order No.

05. 09.07.2026

(Through hybrid Mode)

1. Pursuant to order dated 21.05.2026, the affidavit has been filed by the IIC, Kishannagar Police Station.

2. Paragraph 4,5 and 6 of the affidavit are reproduced below: “4. That it is respectfully submitted that after receipt of the complain report, the present deponent has verified the same and registered the complain bearing

Kishannagar PS Case No. 185 dated 05.06.2026 under section 296, 115(2), 351(2), 3(5).

5. That it is humbly submitted that in the first information contents and letter which is sent to AG Office. Cuttack it has been mentioned as "as per the direction of Hon'ble Court of Odisha Kishannagar PS Case No.

dated 05.06.2026 U/s. 296/115(2)/351(2)/3(5) BNS has been registered on the petitioner's complaint and IIC Kishnnagar PS himself entrusted to investigate the case instead of "as per the instruction received from the complainant Sekh Mohiuddin". It is a typographical mistake. This such type of mistake will never happen by me in future.

6. That it is humbly submitted that this deponent has highest regard for the Hon'ble Court & hold their Lordships in great esteem and is duty bound to implement the order passed by the Hon'ble Court. The deponent has never intended or tried to disobey the Orders passed by this Hon'ble Court in any manner.”

3. The contents of Paragraph-6 contradict the contents of Paragraph-5 and seems to have been made mechanically. As no order has been passed by this High Court, there was no necessity to state that the officer is duty bound to implement the order.

4. Be as it may. Since it has been stated that there was a typographical error in his instructions sent to the Advocate General, further action is not necessary to be taken.

5. Mr. Maneswar Pradhan, IIC, Kishannagar Police Station should be careful while sending instruction to the Office of the learned Advocate General.

6. In order dated 21.05.2026, in paragraph-5, it has been stated as follows: “5. But as regards the other prayers since the instructions have not been obtained by the learned State Counsel in spite of being granted two adjournments, it is directed that police protection shall be provided to the Petitioner and his wife by Opposite Parties No. 3 and 4.”

7. As it has already been directed that police protection will be provided to the Petitioner, the CRLMP is disposed of directing the Opposite Party No. 3 and 4 to provide police protection to the Petitioner as directed by order dated 21.05.2026.
