ORDER

09.07.2026

03. (Through Hybrid Mode)

1. This CRLMP has been filed for a direction to the Opposite Parties to take necessary action and register the FIR against the accused.

2. Pursuant to orders dated 23.06.2026 and 02.07.2026, instructions dated 08.07.2026 of the OIC, Baideswar Police Station is produced by Mr. S.J. Mohanty, learned Additional Standing Counsel.

3. It has been stated in the instructions that after receiving the complaint on 14.07.2025, in view of the nature of allegations, the matter was initially treated as one having civil flavour and effort was made by the then IIC, Baideswar Police Station along with the Diary Charge Officer to amicably resolve the dispute between the parties but no amicable settlement could be arrived at. Thereafter the then IIC and Diary Charge Officer were transferred from the Baideswar Police Station and the present IIC has joined on 10.04.2026. After filing of the present CRLMC, she became acquainted with the facts and thereafter she has made several attempts to contact the Petitioner to appear before the police station so that the matter could be properly examined and appropriate legal action, if warranted, could be taken, but the Petitioner did not cooperate with the enquiry and did not appear before the police station or furnish any other materials.

4. Mr. Sarbeswar Sahoo, learned counsel for the Petitioner submits that the Petitioner has only been contacted by the present IIC once and that too, just two days ago on 07.07.2026 in the night on his mobile number. He further submits that the Petitioner could not go to the Police Station as he is working in Bhubaneswar. He also submits that he is willing to cooperate with the enquiry.

5. It appears that the complaint under Annexure-1 is dated 14.07.2025 and it is stated in Paragraph-8 of the CRLMP that the Petitioner had been called several times to the police station and on 22.07.2025, the Opposite Party No.4 denied to accept the complaint saying that it is a case which is civil in nature.

6. Since the Petitioner has approached this Court after more than ten months after 22.07.2025, I am not inclined to exercise jurisdiction under Article 226 of the Constitution of India and issue any direction for registration of a case.

7. The CRLMP is disposed of granting liberty to the Petitioner to avail the alternative remedy which is available to him under law.

8. It is made clear that this Court has not gone into the merits of the case of the Petitioner.

9. Urgent certified copy of this order be granted on proper application.
